Toledo’s New Fashion Model Contest Rules

Applications are accepted starting June 15, 2009 and ending on July 24, 2009. Applications must be submitted via the official website. Public voting begins on August 1, 2009 and concludes on August 7, 2009.  The winner will be chosen on August 8, 2009 at EPIC Rocks Fashion – Culture and Couture Show “final call” at Levis Commons.  Winners must be present at the live event.

1. You must be 13 years of age or older at the time of registration in order to enter. You must provide proof of identification and birth date, and you (or if under age 18, a parent/guardian) must sign any required releases and documentation, prior to any winner presentation and awarding of prizes.
2. There are two categories: Female and Male.
3. Only one application per person. There is no fee to enter.
4. Applicants must be legal residents of the United States.  Applicants must be amateurs, meaning applicants may not be represented by an agent of under contract with a modeling agency.
   The winners will be chosen by a panel of judges and the voting public (online and/or live).  Voting procedures and methods are at the discretion of the contest chair.  All decisions are final.
   Winning models will be featured in the EPIC Rocks Fashion Show at Levis Commons on September 26, 2009, and will receive $500.00.Winners will also receive a professional model make-over with David Broadway at the David Broadway salon (or approved place of choice to coincide with the photo shoot), and a professional photography shoot with Rick Luetke in which the winner will receive 5 shots, chosen by the photographer and David Broadway, for their portfolio. 5. The winners will be chosen at a live “final call” presentation at Levis Commons on August 8^th, 2009 starting at 7 pm.  Winners must be present to win. 50 male and 50 female finalists will be notified on or before August 7^th for that evening.
6. Incomplete applications may be disqualified. Applications must be accompanied by digital photos uploaded in a JPG (under 100K each) to THE BLADE’s “Toledo’s New Fashion Model” website. Any photo deemed inappropriate by the contest chair will be cause for immediate disqualification. Male and female photos in bikini swimsuits will only be allowed if they are full coverage bikinis only. Any inappropriate or less than full coverage photos of any kind on the site may result in immediate disqualification from the competition.  You may not submit any photos or other materials in which you or any third party claim a copyright.  Applicants are asked to refrain form using their last name in their username and any photo titles. The contest is open to the public, both live and online, any behavior deemed inappropriate by the contest chair will be cause for immediate disqualification and removal from the contest.  Ruling of the contest chair is final.
7. Each winner must attend training sessions and the Epic Rocks Fashion Show on September 26. If a selected winner does not attend, then the winner will forfeit and a runner-up will be awarded Toledo’s New Fashion Model winner.
8. Refusal to abide by these rules or refusal to sign any document reasonably related to the performance of the applicant's obligations set out herein shall result in disqualification and an alternate winner being chosen.
9. Winners are responsible for all federal, state and local taxes associated with the prizes.
10. Rules, schedules, prizes, and event locations are subject to change or revision without notice.
11. WARNING: ANY ATTEMPT TO DAMAGE ANY WEB SITE ASSOCIATED WITH THIS CONTEST OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF LAW, AND, SHOULD SUCH AN ATTEMPT BE MADE, THE BLADE RESERVES THE RIGHT TO PROSECUTE AND SEEK DAMAGES FROM ANY SUCH PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.
12. The contest chair reserves the right at its sole discretion to disqualify anyone he or she finds to be attempting to tamper with or undermine the legitimate operation of the contest; to violate these rules; or to act in an unsportsmanlike or disruptive manner or with the intent to annoy, abuse, threaten, or harass any other person.
13. Release and Limitations of Liability:  By participating in the contest, applicants agree that THE BLADE, Levis Commons, Epic Rocks Fashion, and their respective affiliates, subsidiaries, representatives, consultants, contractors, legal counsel, advertising, public relations, promotional, fulfillment and marketing agencies, web site providers, web masters, and their respective officers, directors, employees, representatives and agents (the “Released Parties”) are not responsible for: (1) any incorrect or inaccurate information, whether caused by applicants, printing errors or by any of the equipment or programming associated with or utilized in the contest; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the contest; or (4) technical or human error which may occur in the administration of the contest.   Use of contest websites by all site visitors is subject to The Blade’s privacy statement and visitor agreement.
    BY PARTICIPATING IN THE CONTEST,APPLICANTS AGREE THAT THE RELEASED PARTIES WILL HAVE NO LIABILITY WHATSOEVER FOR, AND SHALL BE HELD HARMLESS BY APPLICANTS AGAINST, ANY LIABILITY FOR ANY INJURIES, LOSSES OR DAMAGES OF ANY KIND TO PERSONS, INCLUDING PERSONAL INJURY OR DEATH, OR PROPERTY RESULTING IN WHOLE OR IN PART, DIRECTLY OR INDIRECTLY, FROM ACCEPTANCE, POSSESSION, MISUSE, OR USE OF PRIZES, APPLICATION MATERIALS, OR PARTICIPATION IN THE CONTEST OR IN ANY CONTEST RELATED ACTIVITY, OR ANY CLAIMS BASED ON PUBLICITY RIGHTS, DEFAMATION OR INVASION OF PRIVACY, OR MERCHANDISE DELIVERY.
14. Publicity. EXCEPT WHERE PROHIBITED BY LAW, APPLICANTS GRANT TO THE BLADE (WHICH GRANT WILL BE CONFIRMED IN WRITING ON REQUEST OF THE BLADE), ITS SUBSIDIARIES, AFFILIATES, RETAILERS, DISTRIBUTORS, ADVERTISING AND PROMOTION AGENCIES, SUPPLIERS, AND THOSE ACTING PURSUANT TO ITS AUTHORITY, THE RIGHT AND PERMISSION TO PRINT, PUBLISH, BROADCAST, AND USE, WORLDWIDE IN ANY MEDIA NOW KNOWN OR HEREAFTER DEVELOPED, INCLUDING BUT NOT LIMITED TO THE WORLD WIDE WEB, AT ANY TIME OR TIMES, EACH APPLICANT’S NAME, PORTRAIT, PICTURE, VOICE, LIKENESS, AND BIOGRAPHICAL INFORMATION FOR ADVERTISING, TRADE, AND PROMOTIONAL PURPOSES (INCLUDING THE ANNOUNCEMENT OF HIS OR HER NAME ON TELEVISION OR RADIO BROADCAST) WITHOUT ADDITIONAL CONSIDERATION, COMPENSATION, PERMISSION, OR NOTIFICATION.  APPLICANTS AGREE THAT THE BLADE SHALL OWN ALL APPLICATION DATA AND MATERIALS, WHICH WILL NOT BE ACKNOWLEDGED OR RETURNED, AND THAT THE BLADE AND ITS DESIGNEES SHALL HAVE THE PERPETUAL, WORLDWIDE RIGHT TO EDIT, PUBLISH, AND USE THE APPLICATION DATA AND MATERIALS IN ANY WAY AND IN ANY MEDIA FOR TRADE, ADVERTISING, PROMOTIONAL, AND/OR OTHER PURPOSES AS SPONSOR AND/OR ITS DESIGNEES MAY DETERMINE WITHOUT FURTHER CONSIDERATION TO APPLICANTS OR ANY THIRD PARTY.
15. Disputes. Except where prohibited, applicant agrees that: (1) any and all disputes, claims and causes of action arising out of or connected with this contest or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Northern District of Ohio, Western Division or the Court of Common Pleas of Lucas County, Ohio; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this contest, but in no event attorneys’ fees; and (3) under no circumstances will applicants be permitted to obtain awards for, and applicant hereby waives all rights to claim, indirect, punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased.  All issues and questions concerning the construction, validity, interpretation and enforceability of these rules, or the rights and obligations of the applicant and sponsors in connection with the contest, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without reference to conflict of law principles.

Prize

The winner in each category (male and female) is entitled to the following:

• $500.00
• Professional model make-over with David Broadway at the David Broadway salon
• Professional photography shoot with Rick Luetke in which the winner will receive 5 shots, chosen by the photographer and David Broadway, for their portfolio.
